Acceptance of Terms

By accessing and using Xarlenoxghik's website and services, located at 33 Drake Street, CBD, Auckland 1010, New Zealand, you accept and agree to be bound by these Terms of Service. About Our Services

Xarlenoxghik provides art education services, including painting classes, creative workshops, and studio sessions for children and adults in Auckland, New Zealand. Our services are provided in accordance with New Zealand educational and business standards.

Class Registration and Payment

Class registration is subject to availability and is confirmed upon receipt of full payment. All prices are displayed in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) where applicable, as required by New Zealand tax law.

Payment methods accepted include bank transfer, credit card, and other methods as specified at the time of booking. Payment must be received before the commencement of classes unless alternative arrangements have been agreed upon in writing.

Consumer Guarantees Act 1993

Under New Zealand's Consumer Guarantees Act 1993, our services come with certain guarantees that cannot be excluded. These include:

  • Guarantee of Acceptable Quality: Our classes and services will be of acceptable quality, fit for their intended purpose, and match any description provided
  • Guarantee of Fitness for Purpose: Our services will be reasonably fit for the purpose for which they are supplied
  • Guarantee as to Time of Supply: Services will be supplied within a reasonable time

If our services fail to meet these guarantees, you may be entitled to a remedy under the Consumer Guarantees Act 1993.

Cancellation and Refunds

Our cancellation policy is designed to be fair and reasonable while protecting both students and our studio operations. We understand that circumstances may change, and we'll work with you to find the best solution within the framework of New Zealand consumer protection laws.

Studio Rules and Student Conduct

To ensure a safe, positive, and creative environment for all students, we ask that all participants:

  • Respect the studio space, equipment, and art materials
  • Treat instructors, staff, and fellow students with kindness and respect
  • Follow all safety guidelines and instructions provided by instructors
  • Arrive on time for classes and notify us if running late
  • Maintain appropriate behaviour and language in the studio
  • Take responsibility for their own artwork and personal belongings
  • Follow health and safety protocols, including any requirements related to public health

We reserve the right to refuse service or remove any student who engages in disruptive, unsafe, or inappropriate behaviour, without refund.

Health and Safety

While we take all reasonable precautions to ensure a safe environment, participation in art classes involves some inherent risks. Students participate at their own risk and are responsible for their own safety. We recommend that students with allergies, medical conditions, or special requirements inform us before attending classes so we can make appropriate accommodations.

Parents or guardians are responsible for ensuring their children are appropriately supervised and understand studio safety rules.

Intellectual Property

All content on this website, including text, graphics, logos, images, and course materials, is the property of Xarlenoxghik and is protected by New Zealand copyright laws and international copyright treaties.

Students retain ownership of artwork they create during classes. However, we may photograph or display student artwork for promotional purposes unless you notify us otherwise in writing. We will always seek permission before using images of children or their artwork.

You may not reproduce, distribute, or use our course materials, teaching methods, or website content for commercial purposes without our written permission.

Limitation of Liability

To the maximum extent permitted by New Zealand law, Xarlenoxghik, its directors, employees, and instructors will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or website.

Our total liability for any claims relating to our services is limited to the amount you paid for the specific class or service in question. This limitation does not affect your rights under the Consumer Guarantees Act 1993 or any other rights that cannot be excluded by law.

Students participate in classes at their own risk. We are not liable for any injuries, damages, or losses that may occur during classes or while using our facilities, except where such liability cannot be excluded under New Zealand law.

Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which complies with the Privacy Act 2020 of New Zealand. By using our services, you consent to the collection and use of your personal information as described in our Privacy Policy.

Dispute Resolution

If you have a complaint or dispute regarding our services, we encourage you to contact us directly so we can work together to resolve the issue. If we cannot resolve a dispute, you may be entitled to seek resolution through:

  • The Disputes Tribunal (for claims up to $30,000)
  • The District Court or High Court (for larger claims)
  • Alternative dispute resolution services
